General Contest Rules

Note that specific Contests may have rules that vary from the rules set forth herein. In the event the rules of a specific Contest differ from or inconsistent with the rules set forth herein, the rules of the specific Contest shall govern.
An individual (“Contestant”), by entering, attempting to enter, or in any way participating or attempting to participate in any contest, giveaway, or sweepstakes (each a “Contest”) conducted by Zazza Nation, LLC (“Sponsor”),agrees to be bound by the terms and conditions provided in these General Contest Rules and by Sponsor’s interpretations of these General Contest Rules which are final and binding in all matters relating to any Contest.
A copy of these general rules, along with any specific contest rules, if applicable, are available on Sponsor’s website at www.zazzanation.com (the “Website”).
1. No Purchase Necessary. No purchase or payment of any kind is necessary to enter or to win a Contest. Any purchase or payment shall not increase a Contestant’s odds of winning a Contest.
2. Void Where Prohibited. All applicable local, state, andfederal laws and regulations govern all Contests. Participation in a Contest is void where prohibited or otherwise restricted by law.
3. Eligibility. Unless otherwise stated in a specific Contest’s rules, the following terms determine a Contestant’s eligibility.
(a) Only legal U.S. residents age eighteen (18) or older at the time of entry are eligible to participate in Sponsor’s Contests.
(b) Employees, agents, contractors, officers, representatives, or affiliates of Sponsor, its affiliates, participating sponsors, third-party prized provider(s), prize fulfillment service, other radio stations, and advertising companies, and their immediate family members and household members are not eligible to participate. The term “immediate family members” includes spouses, parents, siblings, grandparents, children, grandchildren and cohabiting individuals.
(c) Sponsor may set limitations on how frequently an individual can be eligible to win more than one prize within a specified time period. For national Contests, an individual may win only once (1) every thirty (30) days. However, the same individual may not win more than one trip to a specific event. For local sweepstakes/contests, an individual may win only once (1) every thirty (30) days. Only one (1) winner per household is permitted in any contest or sweepstakes. “Household members” shall mean people who share the same residence at least three (3) months a year. An individual may win an on-going Contest only once per six-month period unless otherwise specifically stated. An individual may win other seasonal or one-time contests only once for the duration of the Contest. Any individual who wins a prize valued at over $600 (Six Hundred Dollars) must wait (sixty) 60 days to be eligible to win any other contests.
4. Entry.
(a) The commencement and termination dates for each Contest will be posted on the Website. “Contest Period” means the period of time between the commencement date and termination date.
(b) During a Contest Period, Contestants may submit entries as advertised or otherwise prescribed by Sponsor for the applicable Contest. Typically, entries will involve one or some of the following: (i) online entry, (ii) phone-in entry, (iii) text entry, or (iv) content submission or skill contest.
Note: Listeners to streamed broadcasts mayexperience different amounts of lag in transmissions due to buffering limitations of various devices and streaming services and may as a result hear
a solicitation to call in their entry later than listeners listening through a different streaming service. As a result, the odds of one Contestant may be slightly different than another Contestant based purely on the device or the service through which they chose to participate.(c) All entries must be received by Sponsor within the Contest Period. Late, incomplete, inaccurate, or illegible entries shall not be accepted and will be discarded.
(d) Online Entry. If a Contest accepts web or in-app entries, Contestants must accurately complete all required fields.
(e) Phone-In Entry. Contestant must be the designated caller, from all callers phoning in to the participating station, to the telephone number announced on the participating station. If eligible, the designated caller will be announced as a potential winner. However, if Sponsor determines the designated caller is not eligible, Sponsor may select the next consecutive eligible caller as the potential winner for the applicable Contest.
5. Selection of Winner. The prizewinner for each Contest shall be selected in accordance with the terms and conditions announced for such Contest.
(a) Unless otherwise provided in a Contest’s specific rules, one (1) winner will be selected from the group of eligible Contestants for each available prize.
(b) The probabilities of winning a Contest are subject to many factors, including but not limited to the number of prizes available and the number of eligible
Contestants that enter such Contest.(c) For Contests involving a winner chosen by drawing of a random entry, the drawing will happen after the termination of the Contest Period. For Contests that involving the Contestant answering trivia, providing information, or otherwise performing or submitting content to participate and qualify to win, the decisions of Sponsor or any applicable judges shall be binding as to all
matters.(d) In the event Sponsor, in its sole and absolute discretion, determines a Contestant chosen as a winner is not eligible to receive a Contest’s prize, another Contestant will be chosen that is eligible will be chosen.
(e) Contestants who do or attempt to violate, gain an unfair advantage, or obtain the status of winner by violating any rules of a Contest will be disqualified and their entry deemed invalid.
6. Prizes.
(a) All prizes are awarded on an “as is” basis. Prizes may not be sold, traded,transferred, substituted or redeemed for cash except in Sponsor’s sole discretion.
(b) Prizes and their respective value will vary for each Contest. Descriptions of prizes will be announced for each Contest separately. The details and availability of prizes are subject to change.
(c) Sponsor is not the guarantor nor the supplier of any prizes unless explicitly specified otherwise. Some prize fulfillment may be the obligation of third parties. Sponsor shall not be liable for the failure of third parties to deliver any prizes to winners. Sponsor does not make and is not liable for any representations or warranties
7. Taxes.
(a) All local, state, federal, and other applicable taxes, duties, tariffs, or other fees for each prize awarded become the sole responsibility of the winning Contestant for such prize.
(b) Any person awarded a prize with over a $600 value will be issued an IRS Form 1099 recognizing the value of the prize(s) to the Internal Revenue Servies (“IRS”).
8. Limitations on Liability; Releases.
(a) Contestant, by participating in a Contest, acknowledges, understands, and agrees to release and waive any and all claims of liability against Sponsor, any applicable third party fulfilling prizing, and each of their respective employees, agents, and affiliates, (“Released Parties”).
(b) All costs and expenses a winning Contestant may incur related to the acceptance of a prize, a prize, or using a prize in a manner not specified as being provided by Sponsor are the sole responsibility of the winning Contestant.
(c) Contestant, by participating in a Contest, acknowledges, understands, and agrees that Released Parties shall have no liability for any injury, misfortune, damage to property or persons.
(d) Contestant, by partipating in a Contest through any app or the website first mentioned above, acknowleges, understands, and agrees that Apple , Google Play, and their affiliates do not have any affiliation with any Contests and are not responsible for any losses, expenses, or decreases in chances of winning of Contestant.
9. Miscellaneous.
(a) Contestant acknowledges and agrees that Contestant will not under any circumstance be permitted to be awarded costs, judgments, or other fees for other than for actual third-party out-of-pocket expenses.
(b) All issues and questions concerning the construction, validity, interpretation and enforceability of the Contest Official Rules, or the rights and obligations of entrant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the State of Florida without giving effect to the conflict of laws rules thereof.
